What the Bhu Kanoon is, in one paragraph
The Bhu Kanoon (literally, "land law") is the set of rules governing who can own land in Uttarakhand. In February 2025, the state assembly passed a sweeping amendment that made these rules the strictest since Uttarakhand was formed in 2000. The stated purpose is to protect the state's fragile Himalayan ecology and the land rights of local residents from unchecked outside investment. The practical effect: if you do not hold an Uttarakhand domicile, you are an "outsider," and what you can buy is now tightly limited.
Who counts as an outsider?
Anyone without a permanent residence or domicile certificate of Uttarakhand — even if you have family, business, or long-standing connections in the state. Citizenship of India does not make you a resident of Uttarakhand for this purpose.
What outsiders CAN buy
The law did not close the door entirely. As an outsider, you can still buy residential property — but within strict size limits.
- Residential land: up to 250 square metres (about 2,690 sq ft, or roughly 1.25 nali) — and only once per family, as a lifetime entitlement.
- Within municipal (nagar nigam) areas: you can buy land or built houses, but the 250 sq m plot limit still applies to land purchases.
- Commercial property: permitted in designated commercial zones, subject to local zoning and approvals.
What outsiders CANNOT buy
- Agricultural land: banned for outsiders in 11 of the state's 13 districts.
- Horticultural land: same blanket ban across those 11 districts.
- More than one residential plot: you cannot buy multiple plots to get around the 250 sq m cap.
- Land in family or friends' names to bypass limits: explicitly prohibited.
The two districts where agricultural/horticultural purchase by outsiders remains possible — subject to state approval — are Haridwar and Udham Singh Nagar. The 11 restricted hill districts include Dehradun, Pauri Garhwal, Tehri Garhwal, Uttarkashi, Rudraprayag, Chamoli, Nainital, Pithoragarh, Champawat, Almora, and Bageshwar.
The new compliance requirements
Beyond size limits, the 2025 amendment added enforcement machinery that did not exist before:
- Mandatory affidavit: every outsider buyer must file a sworn declaration of intended land use and confirm they have not already exhausted their lifetime residential entitlement.
- Online monitoring portal: all outsider purchases are now tracked digitally across districts.
- District Magistrate discretion removed: earlier, a DM could grant special permissions; the new process is standardised and online.
- Repossession clause: if land is used for a purpose other than declared, or limits are breached, the state can reclaim it.
Why this raises the stakes
Before 2025, a bad purchase meant a legal dispute. Now it can mean the state takes the land back. That is a fundamentally different level of risk — and exactly why verifying compliance before you sign matters more in Uttarakhand than anywhere else in India.

- Confirm the land classification on the official Bhulekh Uttarakhand portal — is it residential, agricultural, or horticultural?
- Confirm the district — is agricultural purchase even legal there for an outsider?
- Confirm the size against the 250 sq m residential cap.
- Confirm you (and your family) have not already used your lifetime entitlement.
- Confirm the seller's name in the Khasra-Khatauni record matches the person selling to you.
